These General Conditions of Sale govern purchases made through the website www.crucaviar.it and regulate the contractual relationship between the Customer and Caviar Import S.r.l.

The website is dedicated to the sale of premium gourmet products, including fresh and refrigerated products, intended for private and professional customers in Italy and in the European Union.

These conditions are governed by the applicable Italian and European legislation, including:

The submission of an order by the Customer constitutes a contractual offer.

The contract is deemed concluded at the moment Caviar Import S.r.l. sends confirmation of the order by email.

The Company reserves the right to refuse or cancel orders in the event of:
• incomplete, incorrect or false data;
• suspected fraudulent activity;
• previous contractual defaults.

The products are described in their respective product pages.

Images are for illustrative purposes only.

The Customer is required to check ingredients, allergens and storage instructions carefully before consumption.

The Customer is also responsible for checking any personal allergies or intolerances. Caviar Import S.r.l. is not liable for adverse reactions arising from improper use or from failure to check the information provided.

All prices are expressed in Euro and include VAT.

The price applied is the one indicated at the time of the order.

The following payment methods are accepted:

• PayPal
• advance bank transfer

Transactions are protected by systems compliant with the applicable security standards.

Caviar Import S.r.l. is not liable for the fraudulent use of payment instruments attributable to third parties, except in cases of wilful misconduct or gross negligence.

The electronic invoice is issued through the Italian Exchange System (SDI) in accordance with current legislation.

A courtesy copy may be sent to the email address indicated by the Customer.

Shipments are made within Italy and to European Union countries using insulated packaging suitable for ensuring the correct preservation of the product during transport.
Orders are handed over to the courier with delivery expected within 24/48 working hours of payment confirmation. Deliveries are not made on Saturdays, Sundays or public holidays.
During periods of particularly high shipping volumes (such as holidays and seasonal occasions) or for reasons beyond our control, delivery times may exceptionally take up to one week.
For certain destinations subject to particular logistical conditions, such as islands, mountain locations, remote areas or restricted traffic zones, delivery times may be longer than the standard times indicated. In these cases, we invite you to contact us for the precise expected delivery date.
For urgent requirements, we invite you to contact us before placing your order to check the delivery date. We will be glad to give your request priority and will do our best to find the transport solution best suited to your needs.

QUICK SUMMARY:

The risk of loss or damage passes to the Customer upon physical delivery of the product.
In the event of failed delivery due to the absence of the recipient, an incorrect address or failure to collect, the cold chain cannot be guaranteed and Caviar Import S.r.l. may not be held liable for any deterioration in the quality of the product.

Upon delivery the Customer is required to check:
• the integrity of the packaging;
• the conformity of the products received.

Any damage must be reported to the courier immediately by accepting the delivery subject to reservation.

The Customer authorises the carrier to deliver also to persons present at the address indicated (e.g. concierge, reception, cohabitants), unless otherwise instructed.

Pursuant to articles 52 et seq. of Legislative Decree 206/2005 (Consumer Code), Customers acting as consumers have the right to withdraw from the contract within 14 days of delivery of the product, without having to give a reason.

The right of withdrawal is excluded in the cases provided for by article 59 of the Consumer Code, and in particular withdrawal is excluded only where the goods are perishable or liable to deteriorate rapidly.

For products that are not perishable and not liable to rapid deterioration (by way of example: long-life products, spices, preserves), the right of withdrawal remains fully applicable within the terms established by law.

The Customer acknowledges that, for reasons of hygiene and product quality, the right of withdrawal may not be exercised where the product has been opened after delivery or shows signs of tampering.

Return costs are borne by the Customer.

The refund will be made within 14 days of receipt of the notice of withdrawal, without prejudice to the seller’s right to withhold the refund until the goods are received or proof of shipment is provided

Articles 128 et seq. of the Consumer Code apply.

For perishable food products, any defects must be reported within 24 hours of delivery.

The warranty applies within the limits of the perishable nature of the products.

In the event of a non-conforming product, the Customer is entitled to:
• replacement;
• a price reduction;
• termination of the contract with a refund.

Caviar Import S.r.l. shall not be liable for delays or failures to perform due to events of force majeure, third-party service disruptions or logistical interruptions beyond its control.

No guarantee is given as to the complete absence of technical errors, service interruptions or IT problems affecting the website.

The contract is governed by Italian law.
For Customers acting as consumers, the competent court is that of their place of residence or domicile.

• pandemics
• logistical or energy disruptions
• measures taken by the authorities

All content on the website (texts, images, trademarks, logos and graphic material) is the property of Caviar Import S.r.l. or of the respective owners and may not be used without written authorisation.

These General Conditions are accepted by ticking the relevant box during the purchase procedure (checkout), pursuant to articles 1341 and 1342 of the Italian Civil Code.
The Customer further declares that they expressly approve the following clauses which, pursuant to articles 1341 and 1342 of the Civil Code, are onerous or limit liability:
